Update: Assisted Decision Making (Capacity) Act and Care Representative Applications

The Assisted Decision Making (Capacity)(Amendment) Act, 2022 completed its passage through the Houses of the Oireachtas and was signed by the President on 17th December.   No commencement date is available at this time for this Act or the original Assisted Decision Making (Capacity) Act, 2015.  The Courts Service continues to work with the Decision Support Service (DSS) and other agencies & committees to prepare for the commencement of the Act and we will provide further information soon after a commencement date becomes available.

Please note, for Care Representative applications, Section 102 of the 2022 Act amends Section 21 of the Nursing Home Support Scheme Act, 2009, no new applications, under these current procedures, can be accepted on or after commencement of the new legislation.
